Delay in filing T.P.(Crl.) No(s).955-956 of 2025 is condoned.
These petitions have been filed by the petitioner wife-Abhida Dhariwal (Abhidha) for transfer of the petition filed under Section 13(1)(ia) of the Hindu Marriage Act, 1955 in FCOP No.369 of 2023 and the petition filed by the respondent-husband under the Domestic Violence Act in Complaint Case No.14218 of 2019 respectively.
This Court having held that there is possibility of a settlement, had referred the parties to the Supreme Court Mediation Centre and a report has been forwarded stating thereunder that the dispute has been resolved between the parties by entering into an agreement.
The said agreement is placed on record along with the I.A.No.261059 of 2025 which has been filed on behalf of both the parties seeking a decree of divorce and dissolution of the marriage solemnised between them by exercise of the power under Article 142 of the Constitution of India.
We have interacted with the parties and they have reiterated the contents of the compromise petition. The petitioner-wife-Abhida Dhariwal (Abhidha) is present virtually and the respondent-husband physically.
During the course of interaction they have agreed and consented that the terms of dissolution of marriage have been reduced into writing out of their own free will and volition without any force, threat or coercion. They also stated that after having understood the contents of the settlement, they have affixed their signatures voluntarily.
The learned Advocates, who are present before the court, have identified the parties who are present virtually and physically.
In that view of the matter, we find no impediment to accept the said settlement particularly in the backdrop of both being adults and educated and having understood the contents of the compromise petition. It is also agreed between the parties that various disputes which are pending between them as set out in paragraph 3(I) to 3(V) can be closed.
In view of the afore-stated facts, we are of the considered view that the compromise petition for settlement as agreed to between the parties, deserves to be accepted and on account of the marriage between the parties, having been irretrievably broken down and there being no chance of parties being united again, as evidenced from the interaction we had with the parties, we deem it just and proper to dissolve the marriage solemnised between the parties on 06.03.2018.
The petitioner-wife-Abhida Dhariwal (Abhidha) has stated that she has received Rs.23 Lakhs towards permanent alimony by way of demand draft and she has no further claim and it is in full and final settlement of her claims. The copy of the demand draft which was earlier handed over and today in court the original demand draft is handed over to the learned counsel appearing for the petitioner-wife-Abhida Dhariwal (Abhidha) and he has acknowledged the receipt of the same.
Accordingly, the Transfer Petitions are disposed of and the marriage solemnised between the parties on 06.03.2018 stands dissolved. Pending proceedings between the parties as indicated in paragraphs 3(I) to 3(V) of the settlement agreement stands quashed or disposed of. Both the parties are at liberty to bring it to the notice of the respective courts and the Registry shall also intimate the respective courts of the outcome of these proceedings so as to enable the courts to take necessary steps for closure of the proceedings.
Pending application(s), if any, shall stand disposed of.
